You agree to use the website and purchase products solely for your own personal and non-commercial use, and not on behalf of any other party.

4. Pricing

4.1 Product prices include delivery charges but exclude taxes, duties, and government fees.
4.2 You are solely responsible for all import duties, customs fees, and taxes. Our products are shipped duty unpaid and untaxed from China, and you act as the importer of record. Please check your country’s import regulations before ordering.
4.3 We strive for price accuracy, but in case of an error, you will be notified and given the option to reconfirm or cancel your order.
4.4 We are not obligated to honor incorrect prices, even after order confirmation.
4.5 Prices may change, but any confirmed order will remain unaffected.

5. Placing an Order

5.1 Orders are subject to stock availability.
5.2 A binding contract forms only once we send an Order Confirmation email.
5.3 Multiple products may be delivered separately.
5.4 We may remove products or content from the website at any time without liability.
5.5 We reserve the right to reject or cancel any order.
5.6 If we cancel an already paid order, you’ll receive a full refund.

6. Payment

6.1 Payments are processed via listed payment intermediaries on our website.
6.2 Promotional vouchers may be used at checkout.
6.3 We may share your personal data with payment intermediaries.
6.4 We are not responsible for payment processing errors.
6.5 You confirm all payment details are accurate and that you have sufficient funds.
6.6 We are not liable for any unauthorized card usage.
6.7 You agree not to initiate chargebacks without first contacting us to resolve the issue. We reserve the right to dispute any chargebacks that do not comply with our return and refund policies.
6.8 You will indemnify us for any chargebacks or payment reversals.

7. Delivery

7.1 For information about order processing times, delivery estimates, and shipping updates, please refer to our Shipping Policy.
7.2 Delivery estimates are provided at checkout but are not guaranteed.
7.3 We are not liable for delays beyond our control.
7.4 If delivery to your location is not possible, your order will be canceled and refunded.
7.5 Risk passes to you upon delivery, unless delayed by your breach.
7.6 Missed deliveries may incur redelivery or return fees.
7.7 Standard delivery: 7–12 business days, occasionally up to 4 weeks.
7.8 All products are shipped duty unpaid and untaxed. See Section 4 for more.

8. Cancellations & Modifications

8.1 You may request a cancellation by email after placing an order.
8.2 Orders already packed or in transit cannot be canceled — they must be returned after delivery.
8.3 Early refunds are only possible within 24 hours or 16 weeks after ordering if the goods have not been received.

9. Defective Products

9.1 Products are not custom-made.
9.2 Product info and images are for reference only.
9.3 Faulty items can be reported via email with photo evidence.
9.4 If accepted as faulty, we will offer either a replacement or full refund.
9.5 If not deemed faulty, we may reject the return and charge a service fee.

10. Returns & Refunds

10.1 You may return products within 30 days of receiving them.
10.2 Return shipping is at your own cost.
10.3 Products must be unused, in original packaging, and in sellable condition.
10.4 Refunds will be issued to the original payment method after inspection.
10.5 Early refunds may be delayed if products are not received or verified.

11. Vouchers

11.1 Only one voucher or discount code per order.
11.2 Vouchers hold no cash value and do not earn interest.
11.3 Used voucher value is not refundable.

12. Acceptable Use Policy

12.1 You must not misuse the site, conduct unlawful activities, or use bots or scrapers.
12.2 Do not attempt to reverse engineer, copy, or replicate the site.
12.3 Violations may result in suspension, legal action, or reporting to authorities.

13. Website Linking

13.1 You may link to our homepage, provided it’s done legally and fairly.
13.2 Framing or deep linking is prohibited.
13.3 We may revoke linking permission at any time.

14. Intellectual Property

17.2 Our total liability is capped at US$1,000 or 5x the product price, whichever is higher.
17.3 This does not affect rights relating to death, personal injury, or fraud.

18. Indemnity

You agree to indemnify us against losses arising from your breach of these Terms, misuse of the Website, or unlawful behavior.

19. Force Majeure

In the event of circumstances beyond our control, we may cancel orders and refund payments.

20. Changes to Terms

We may update these Terms at any time. Continued use of the site implies acceptance.

21. Breaches

Violations of these Terms may result in account suspension, order cancellation, or legal action.

22. Termination

We may suspend or terminate access to the site at any time without notice. You may stop using the site at any time.

23. After Termination

Termination of these Terms ends all rights of access. Sections relating to liability and indemnity remain in effect.

24. General Provisions

These Terms are binding, non-transferable, and governed by the laws of the United States. Invalid clauses will not affect the rest.

25. Governing Law & Jurisdiction

These Terms and any dispute arising out of or in connection with your use of the website, our products, or services shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.

You agree that any dispute, claim, or controversy between you and Fash Cove arising out of or relating to these Terms — including disputes regarding the validity, interpretation, enforcement, or breach thereof — shall be resolved exclusively through final and binding arbitration, conducted in English by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA).

The arbitration shall take place in Charlotte, North Carolina, unless otherwise mutually agreed. Each party shall bear its own legal fees and costs, except where otherwise required by law or awarded by the arbitrator.

You may opt out of binding arbitration by notifying us in writing within 30 days of your first purchase. If you do not opt out, you waive your right to a jury trial or to participate in a class action.
